Corporate personhood is a cancer that will eventually eat away at our democracy. We had a functioning democracy before corporations existed in our country. So let us not be deluded into thinking that crony-capitalism is essential to our democratic republic.

In response to cromulant above, isnt that what is going on now? Over a century of corporate personhood has brought us to the brink of socialism. Our government now thinks that our corporations are too big to fail. That the country cannot survive without them. Because of this idea, our government has saddled the humans of this country with debt up to our eyeballs. It is debt that human taxpayers will have to pay back. Not the corporations that actually received the bailouts. The war has already been brought to our doorsteps. It is corporations versus the people and right now the corporations are winning at the expense of the people. Removing corporate personhood would be a shot across their bows.

I think Dr. Aranoff has it absoultely right in his description of legal fictions. But I think the civil war it will take to overturn "property is a person" could be far more violent than the war between the states. The fighters won't be wearing uniforms. The war departments won't be tallying the dead and writing letters to the loved ones. The bullets may be real or economic---but you are talking war if change is to come about.

We have to think about the unfair treatment we receive from corporations.

Slavery is the legal fiction that a person is property. Corporate personhood is the legal fiction that property is a person. Like abolishing slavery, the work of eradicating corporate personhood takes us to the deepest questions of what it means to be human. And if we are to live in a democracy, what does it mean to be sovereign? The hardest part of eliminating corporate personhood is believing that We the People have the sovereign right to do this. It comes down to us being clear about who's in charge.
