Habeas Corpus has been a stalwart freedom since the 1500's. Any person held by the United States, whether American citizen or not, has a right to habeas corpus. "We the People" must protect the rights of others, or we might find, that it is not long before our rights are taken away.

I have to thank the Bush administration for helping me wake up. When I learned about what's been going on I used to think 'what's happened to my country?'. Then I learned more and found it's always been this way, more or less. Our history is riddled with this kind of sickness despite having one of the greatest documents written as our foundation. And it's always been the people who've been forced to take back our rights and reverse these perversions.

One more thing to note: Another reason this is such an issue is because the military now operates largely outside the Constitution with its own rules, which is frighteningly similar to a mercenary force. How is a soldier supposed to fight for a nation whose Constitution no longer covers him or her in every aspect due to simply enlistment in a military branch?! Every soldier or civilian at Guantanamo Bay is a citizen of America and as such should base responsibilities to others on Constitutional norms. Otherwise, one could argue, that everyone at the Bay should live under the rules and laws of the owners of the land, Cuba. That would not go over well though, now would it?

The very notion that the U.S. Constitution depends on the land upon which American activities exist and not upon American citizenry is appalling. If the U.S. Constitution does not cover the physical area of Guantanamo Bay, then the same could be said for all embassies and military bases abroad thus making embassy diplomatic immunity rather hollow. Needless to say, I find the removal of habeas corpus from any U.S.-held facility to be disturbing and also to be evidence that our current Congress and President may not have much objection to removing, via legislation, that fundamental right from Americans as well when it suits them or becomes convenient.
