From Tea Party to Treason
An anti-Obama activist finds a grand jury to consider his extreme charges.

Tea-party style activism has taken some nutty turns before—the Hitler references, the Holocaust pictures. But Walter Fitzpatrick III may be about to push anti-Obama activism to new heights. On Tuesday, he plans to walk into the Monroe County courthouse in tiny Madisonville, Tennessee, and attempt to convince a local grand jury to indict the president on treason and fraud charges.
Fitzpatrick is one of those alternate-reality Americans who believe that Barack Obama is actually one Barry Soetoro, a man who is not an American citizen and thus ineligible to serve as president. Fitzpatrick claims that since March, he has been trying to get federal prosecutors in Tennessee to bring treason charges against the president. All that effort earned him, however, was a visit from the Secret Service.
But then Fitzpatrick evidently discovered that Monroe County has rather liberal rules about grand juries. In most places, only a local prosecutor can present evidence to a grand jury and request an indictment. In Monroe County, any private citizen can show up with a petition and seek an indictment. The most common initiators of such proceedings are usually victims of robberies or assaults, however, not activists trying to unseat the president.

Fitzpatrick tried this once already, filing a brief in late August that read, in part:
OBAMA-SOETORO IS MY SWORN ENEMY! - And as there were TRAITORS to Italy in Caesars day, I report to this GRAND JURY with force and authority there are senior military officers no more obedient to the CONSTITUTION than their criminal DICTATOR, OBAMA-SOETORO.
But the attempt didn’t go very well. JB Williams, a frequent contributor to the conservative website Town Hall and apparently something of an unofficial spokesman for Fitzpatrick, wrote that the local DA and the grand jury foreman threw Fitzpatrick out of court. (Fitzpatrick could not be reached for a response, and the district attorney was unavailable to comment on this account.)*
Fitzpatrick’s supporters frequently cite his status as a retired Navy lieutenant commander as proof of his integrity and patriotism. What they fail to mention is that in 1990 he was court-martialed for financial negligence, a move that essentially ended his military career. He runs a blog called JAG Hunters, and reportedly lives in Sweetwater, Tennessee. His website provides all the information activists need to file their own treason charges against Obama, and he invites people to copy him on their filings so that he can publicize their efforts. He lists seven others who’ve joined the crusade so far.
Fitzpatrick is hardly the first to attempt legal proceedings against Obama, but his scheme is unique in that it involves criminal allegations. Those challenging Obama’s citizenship in court have usually done so via civil suits (most of which have been thrown out by unsympathetic judges). Others have convened mock "citizens" grand juries to "indict" the president, sending the charging documents to local prosecutors in North Carolina and elsewhere. So far, no prosecutors have taken up the case.
Fitzpatrick is trying to appeal directly to the people through a grand jury comprised of average citizens who volunteer their time. Still, unless the jurors of Monroe County are truly rabid Obama haters, it seems unlikely that they will be persuaded—or that they even have the power to indict the president in the first place. Treason, after all, is a federal crime, not a county-level offense. When I asked a court employee whether the Monroe County grand jury has jurisdiction to indict a sitting president, she seemed rather baffled: "I wouldn’t think so. That would not go before a local court." She observed that the grand jury won’t issue any decision on the case until December 7. But for any real criminal charges to go forward, the local district attorney would have to agree to take up the case, a move that any sane prosecutor would be reluctant to make.
Still, the futility of Fitzpatrick’s enterprise hasn't deterred self-declared "patriots" across the country from rallying around the news of his testimony and planning caravans to descend on Madisonville to lend moral support. The Tennessee chapter of Sons of Liberty Riders, for instance, will be convening at the Sweetwater Comfort Inn at 7 a.m. before riding their choppers to the courthouse.
The planned rally came as a big surprise to courthouse employees. When I told one staffer about the caravan, she was shocked, noting that Madisonville was a tiny place where not much ever happens. She exclaimed, "Maybe we should tell the restaurant across the street!"
*UPDATE: James Stutts, the Monroe County District Attorney, left a message Monday night saying that in fact, Fitzpatrick testified for two hours before the grand jury in August and the jury declined to bring any charges based on his testimony. He also disputes Fitzpatrick's characterization of that appearance and says the former Navy man was not physicially restrained in any way nor was he forced from the courtroom.

The Lily Ledbetter Act applies to a handful of women, and its purpose is to cover a technicality of law.
The current healthcare plan will put more Americans into poverty and is not affordable. The House version would cost me $2,500 more per year than what I was paying for health insurance when I lived in the US. It's also asking me to pick up the tab for the unhealthy habits of the majority of Americans. It's bad enough to pay into Medicare and Social Security knowing I'll never see a dime, but asking me and my husband to fork out $10K a year for insurance is criminal. I am all for charity, but not mandated charity. Furthermore, I don't want government to have access to my medical records. No one should. Just think, info about your abortions, STDs, depression alcoholism, drug use, and all that other good stuff becomes property of a government politician. I know several women who won't run for office because they have had abortions and are afraid it will come out if they run for office. Imagine what would happen if the government know everyone's little secrets.
Obama was elected because he promised to end the wars. He has failed miserably on that front.

The economy was in the can when Clinton took over. In 1992, the US was technically bankrupt. Clinton raided Social Security to balance the budgets and left non-marketable IOUS in the till. It wouldn't have mattered if Gore and Kerry won - the system was designed to fail from the start.

Regardless, according to the Village Voice, Fitzgerald was going to court to address Posse Comitatus. That the author of the MJ article did not address this and had to throw in the BC stuff says much about the bias. Disinfo at it's finest!

I am not an Obama Supporter at all. I didn't vote for him and don't trust him to end the war or keep any campaign promises. HOWEVER, that is not what this aticle is about. As to the president, when he began his campaign in 2007, our country looked very different. Our economy wasn't in the tank, our jobless rate wasn't through the ceiling and we weren't in danger of a second great depression. Many of the priorities of the candidate Obama had to be rearranged or changed and there were many more issues to contend with by the time the inaugeration rolled around. Some of them, like health care, are important to deal with now, even more so, with all the job loss and people losing insurance. Instead of 47 million uninsured we have many more. No one can state what the reform will cost them, as someone did previously, because it isn't done yet. While I don't like what I am hearing out of the Senate version because it doesn't go far enough, until they have a finished version we don't know what it will look like. I know the president has offered time and time again to work with the repuglicans and they refuse to do so in good faith. They ask for amendments and then refuse to vote for it even when they get want they want. They don't care how many people are hurting, in need of health care, they just want to keep the president from succeeding at anything. How can change happen when Obama has to deal with fools who act more like juvenile delinquents than responsible men and women? When their main interest is collapsing the presidents plans and not the citizens of this country, they have no business being there. I can't say I am happy with the democrats either- they need to get it together. But I am sick to death of the fools in the repuglican party. They have a token chair and radio/tv windbags that have more power than the jerks in the House and Senate. What a circus! How can any change occur in that atmosphere?

A republic is not necessarily a democracy. The discussion was not what defines a republic (lacking a monarch is only one definition), but the difference between a republic and a democracy.
As I am sure that Mr. Anonymous poster knows, democracy means the majority has control over the minority. There is no charter or constitutional protection of individual rights. The will of the majority rules.
A republic has more safeguards. The government is restrained by the charter, in the case if the US, the Constitution, which protects the rights of individuals.
The US has the Electoral College, wherein even if the majority of the population elects a President, the minority vote winner can still win the election.
We live in a republic, not a democracy. Monarchy is irrelevant.

I've lived in Tennessee all my life and I don't hate blacks, nor have I ever thought that a roll of twenty ones was a big deal. I **am** a Democrat, but I'm the only one in my family and am represented in the Senate by two Republicans. Sadly, we're not ALL Democrats.
I'm just up the road from Pulaski, the birthplace of the KKK and they get little if any attention around here--not a group we're particularly proud of.

Bush/Cheney/Rumsfeld/Rice/Rove/Powell/who am i forgetting all need to be impeached for lying us into a war in Iraq for the oil. Bush doubles our national deficit in 8 years and then the GOP under Obama complain about our debt.
And yet these thinly veiled racists look for any reason to lynch Obama.
And yet these people call themselves 'intelligent' life. I'm embarrassed to share my race with you.
For the record, I think both parties are corrupt, on the same payroll, 2 sides of the same coin, to give the uninterested public the illusion of democracy. Clinton got impeached for lying about a blow job; Bush illegally and against our very founding document, the Constitution of the United States, invades a foreign country that had absolutely nothing to do with 9/11 (which could have been prevented had warnings from foreign and domestic sources not been ignored... see
